Mr. Konstantin Pilkov, managing partner of Cai & Lenard, provided
expert comment to News TV Channel "24" relative to the liability of
carriers carrying out international passenger traffic.
Let us
recall that the corresponding law entered into force on 6 April 2011 and
obliged carriers to check passengers’ documents required for entry into the
country of destination. The law also defines the liability of transport
companies for violations of its rules.
According to
Mr. Pilkov, the entry into force of these rules was a necessary step for
the fulfillment of Ukraine’s commitments under the Council of Europe Convention
on Action against Trafficking in Human Beings.
However,the
attorneyexpressed doubt that such a remedy would be effective in
combating human trafficking and emphasized that the Law also imposes a duty on
carriers to turn persons having no visa documents to the country of
departure or to the country that issued such person’s passport.
“It is the
duty of the state border guards and internal affairs bodies, which should not
be passed on the carriers. In addition, the Council of Europe Convention does
not entrust such responsibilities on carriers”, - said Konstantin Pilkov.
