Litigation with tax authorities: attorney’s opinion
A round table discussion entitled “Pro and contra: do
tax disputes indicate economic freedom in Ukraine? Opinions of court trial
participants” was held today. The round table was organized by the District Administrative Court of Kyiv.
The event
brought together judges, representatives of the Ukrainian Bar Association, attorneys
and scientists. The experts discussed peculiarities and key aspects of the
court practice in tax disputes, its impact on tax authorities’ work and other
relevant issues.

Cai & Lenard Law Firm at the event.
He draw his colleagues’ attention to the fact that according to the “Taxpayer is Right” Index, which is
calculated by the Firm’s tax experts on a quarterly basis, in 2014 taxpayers’
chances for successful disputing of the Ukrainian tax authorities’ decision-notices,
equalled 86.59%. This means that courts supported the taxpayers in 87 cases out
of 100 on average, and the tax authorities found support in courts only in 13
cases.
“The business is firm in belief that the tax authorities are invincible and
no one can change their decisions, but for several years, the Index shows a
reverse tendency”, Mr. Pilkov noted.

Index shows
in whose favour (taxpayers or tax authorities) judgements were taken in case a
taxpayer disputed tax authorities’ decision-notices. From two to three thousand judicial decisions are analyzed monthly to
